Sir: Referring to the Embassy’s despatch No. 7
of September 23, 1913,7
in regard to the method of procedure in approving the protocol
stipulating the conditions of transfer of the Foreign Settlements in
Chosen, concluded between the consular representatives in Seoul and the
Government General on April 2 last, I now have the honor to inclose
copies of an exchange of notes, executed in accordance with the
Department’s instructions, with the Minister for Foreign Affairs,
approving the said protocol on the understanding that in the event of
subsequent modifications of the terms thereof American citizens shall
not be placed in a less favorable position than the nationals of the
other powers concerned.
I am forwarding copies of this correspondence to the Consul General at
Seoul.

Your Excellency: Referring to your
excellency’s note No. 62 of August 27 last, I have the honor to
state that my Government is satisfied with the protocol relating to
the adjustment of the Foreign Settlements in Chosen approved by the
consular representatives at Seoul and the Chosen Government General,
deeming it a fair adjustment of the questions involved, and that I
am authorized to proceed to an exchange of notes with your
excellency approving the said protocol in its present form on the
understanding that in the event of subsequent modifications of the
terms thereof American citizens shall not be placed in a less
favorable position than the nationals of the other powers
concerned.

Monsieur l’Ambassadeur: I have the honor
to acknowledge the receipt of your excellency’s note of the 2d
October last informing me that the United States Government are
satisfied with the protocol relating to the adjustment of the
Foreign Settlements in Chosen which was signed at Seoul on the 2d
April last, and that you are authorized to proceed to an exchange of
notes approving the said protocol in its present form on the
understanding that in the event of

subsequent modifications of the terms thereof
American citizens shall not be placed in a less favorable position
than the nationals of the other powers concerned.
I beg to state that the Imperial Government, having no objection to
the proposed understanding, are desirous to bring to a conclusion,
with the present note in reply to your excellency’s note under
acknowledgment, the exchange of notes required for the approval of
the protocol in question.

Your Excellency: Referring to your
excellency’s note No. 25 of the 20th instant, I have the honor to
state that I concur in the proposal to bring to a conclusion with
that note in reply to my note of October 2 last, while agreeing to
the understanding as proposed therein, the exchange of notes
required for the approval of the protocol relating to the adjustment
of the Foreign Settlements in Chosen which was signed at Seoul on
April 2, 1913.
