The Ambassador in Colombia (Lane) to the Secretary of State

1287. The following memorandum has been delivered to Minister of Foreign Affairs:

“The Embassy has been informed that the Judge of the Second Municipal Labor Court of Bogotá, Dr. Alfredo Gutierrez, has addressed a communication No. 309 to the manager of the National City Bank of New York at Bogotá transcribing a court order dated July 14, 1944 whereby the Judge decrees the embargo of the funds of the Rubber Development Corporation on deposit with that bank. There is attached a copy of this communication. It is understood that similar communications have been addressed to the other banking establishments of Bogotá for the same purpose.

The case referred to in this correspondence is the same case as that referred to in the Embassy’s note of July 7, 1944 transmitting a memorandum of the facts in the claim of Señor Alejandro Arboleda Mesa against the Rubber Development Corporation and requesting that appropriate measures be taken to prevent the execution of any judgment against the Rubber Development Corporation since that Corporation is an official agency of the Government of the United States of America completely owned and controlled by said Government.

In the aforementioned communication from the Judge of the Second Municipal Labor Court to the bank reference is made to Dr. Luis Restrepo as the claimant against the Rubber Development Corporation. While the original claimant was Señor Alejandro Arboleda Mesa, it is understood that the latter has sold his alleged rights to Dr. Restrepo which would account for the change in the name of the claimant.”

A copy of the Embassy’s note of June 7, 1944 referred to above was sent to the Department as an enclosure to Embassy’s despatch 3898 of June 9, 1944.58
