The Consul General at Shanghai (Lockhart) to the Secretary of State

650. The Department’s instructions are respectfully requested as to whether, in view of the provisions of the Neutrality Act,11 neutrality proclamation as published in Radio Bulletin No. 209, September 5, 1939,12 and other provisions of law, the enlistment in China (with its extraterritorial aspects) of American citizens in the British armed forces is a lawful act, those Americans upon enlistment presumably to proceed ultimately to combat zones.

Sent to the Department. Repeated to Chungking and Peiping.
