650. The Department’s instructions are respectfully requested as to whether, in view of the provisions of the Neutrality Act,¹¹ neutrality proclamation as published in Radio Bulletin No. 209, September 5, 1939,¹² and other provisions of law, the enlistment in China (with its extraterritorial aspects) of American citizens in the British armed forces is a lawful act, those Americans upon enlistment presumably to proceed ultimately to combat zones.

Sent to the Department. Repeated to Chungking and Peiping.
