29. Your 48 March 6, noon. I have been in frequent touch recently with the German Ambassador regarding the proposed mock trial.
After careful study I informed Doctor Luther on March 2, that the participants were acting as individuals and not in any sense as representing the Federal Government; that no legal authority could be [Page 512] found that would enable the Federal Government to instruct the participants to refrain from the demonstration contemplated; and that no law clothed the Federal Government with any authority to compel its abandonment.
I feel that any effort to intercede in this matter or to take official cognizance of it would react disadvantageously.
