The High Commissioner in Haiti (Russell) to the Secretary of State

76. Referring to my telegram No. 74 of December 5, 4 p.m.35 Minister of Foreign Affairs states that French-Haitian Agreement of 1923 was discussed between the two Governments at Washington under the supervision of Department of State and that his understanding is that Department approved. He adds that the 1925 agreement has but slightly changed the 1923 agreement. Judge Strong36 informs me that in his opinion the agreement is in conflict with the protocol of 1919 and that modifications in the protocol can only be made by the United States becoming a party to the agreement and its being approved by the Council of State. The protocol of 1919 was approved by the Council of State in the loan law of 1922.37

In view of the above I request the Department’s instructions.
