No. 264. Frothingham. Embassy’s 9131, March 20, 1 p.m., your 310. Impossible to include names enemy trading list on basis nationality as sole ultimate fact. When enemy nationality exists, however, particularly in cases in Scandinavia, it may be possible to draw inferences which will diminish greatly amount of other evidence necessary to add name. In view of European trade conditions and of instructions in my 235, March 22 [23], cases will undoubtedly be rare where there is not circumstantial evidence of business done within enemy lines or trade for benefit of enemy sufficient to include enemy trading list under our rules such names as are passed for B[ritish] S[tatutory] L[ist] under British rules.
