Sir: The Secretary of State having referred me to your letter of the 24th instant, with its inclosures, I have taken the directions of the President on the subject, and in accordance therewith have to request you to institute legal proceedings against *Colonel Kinney and the steamer United States, provided, in, your judgment, the evidence accessible will suffice to afford probable cause. P. S.—Since writing the above, I have seen the letter of Mr. Fabens in the New York Herald of yesterday, which seems to require that he be proceeded against equally with Colonel Kenney.
