Memorandum by the Assistant Chief of the Division of European Affairs (Henderson) to Mr. Wright Thomas of the Division of Exports and Defense Aid

Thank you very much for sending me a copy of the draft agreement42 which I am holding for the time being. In regard to that section relative to the protection of patent rights, we believe that a consideration which should be borne in mind is that the Soviet Government has not hesitated in the past arbitrarily to copy any patented machine or article imported into the Soviet Union without paying any attention to the foreign patentee. There is no reason to believe that the Soviet Government would not continue this practice in the future and would not hesitate to export articles patented in the United States but manufactured in the Soviet Union.
