The Minister in Czechoslovakia (Wright) to the Secretary of State

3. Your telegram No. 50, December 29, 2 p.m. Notwithstanding ruling of the National Bank, reported in my telegram 75, December 22, 11 a.m., and despatch No. 1460 of December 19th of the Consul General,34 the Foreign Office now informs me in writing:
“Referring to the respective inquiry of the American Legation it is [has] to be added that the stipulation[s] of article No. 2, paragraph No. 4, of the said Agreement in case of a direct business between the Czechoslovak importer and American exporter find no application as long as the representative of the American firm in Bremen looks after the correct delivery and transport only. The decisive factor remains the question who issues the invoice.”
Aide-mémoire states further that “The new way of payment for the cotton imported from America is based upon the consideration that a portion of the expenses connected with the import of this raw material consists of payment in German marks—reichsmarks. Should, [Page 167] namely, the business transaction be arranged and done through an agent of Bremen the said portion of reichsmarks contained in the amount of invoice must necessarily be increased by the commission to be paid to the German agent”, as reported in my aforementioned telegram.
