10. Your 27, February 10, 4 p.m. The Department approves a reply similar to the tentative draft which you have submitted. For your consideration the Department suggests that in Paragraph 2, after the words “between China and Japan”, the note should read “but it must continue to hold the Governments and authorities of each of the disputants responsible for any loss or damage which may be inflicted by any armed forces or any agencies thereof to American lives and property as a result of such dispute”.

Repeat to Nanking and inform Tokyo.
