27. Your 26, June 21, noon,9 and 28, June 25, 6 p.m. It was not practicable to expect Senate to reconsider reservation during closing days of session, and Senate can not be expected to consider the matter at the special session.
This Government would be willing to exchange ratifications with the reservation, provided no amendment of the treaty in other respects be made by Austria. In the event that Austria should modify the treaty as signed by shortening the term of the entire treaty, or by other amendment, it would become necessary to refer the treaty again to the Senate of the United States to consider that amendment, which could probably not be done until next December. Thus no purpose would be served by seeking to exchange ratifications of treaty with Senate reservation at this time since Austrian amendment would probably delay entry of treaty into force until next December.
Department would be glad if Austrian Government would see its way to undertake to obtain acceptance of Senate reservation by Austrian Parliament without change of term of entire treaty or other amendment. If such acceptance could be obtained, it would not be necessary to submit treaty to Senate again and the treaty could be brought into force at an early date.
