28. My telegram No. 26, June 21, noon.8 Discussed Senate reservation to article 7, paragraph 6, of commercial treaty with Foreign Office [Page 852] which is willing to accept reservation, in fact it had already been approved in draft of treaty and eliminated shortly before signing. Foreign Office advises me if treaty with reservation is resubmitted to Austrian Parliament for ratification it will undoubtedly be amended to expire in 1935, whereas in present form it will continue for 6 years from exchange of ratifications. Apparently Senate reservation could be safely eliminated as Austria has no transatlantic vessels nor any seaport. It would appear United States has much to gain and little to lose by exchanging ratifications of treaty as signed. To strengthen my position in negotiations with Austrian Government regarding discriminations urge elimination of Senate reservation be again taken up with Foreign Relations Committee if possible before Senate adjourns.
