No. 165. Swedish delegates have received word from Swedish Government saying it considers itself not bound by modus vivendi owing to your new bunkering rules1 of which neither the Swedish delegates here, nor any Allied representatives, had any intimation. The modus vivendi contained the only bunkering arrangements and control of boats that the Swedes are willing to accept, and the Allied position was considered adequately safeguarded by the terms of the modus vivendi. It is most urgent to have matter settled on account of desire of Swedes to get commodities released, especially phosphate rock in time to be of use for crops, and desire of Allies to use modus vivendi ships. Are you not willing make a declaration that your bunkering rules do not apply to modus vivendi? Understand British and French are cabling their Washington Embassy. The matter is urgent so please give this immediate attention.
