In the note I wrote to you recently about the Bricker Amendment,2 I did not mean to imply that the Administration should take the initiative in again raising this question in the Senate. My purpose is simply to guard against the possibility that the matter is brought up again and under such circumstances that we would have no position to take other than a flat negative. I believe that such a position would damage some of our best friends in the Senate for the simple reason that far too many people believe—erroneously it is true—that some kind of positive action must be taken if the Constitutional provisions are to be rigidly observed in the treaty-making process.
