The Embassy in Brazil to the Department of State

The Embassy has the honor to enclose for the Department’s information and records copy of a note, dated July 24, 1947,25 that has been submitted to the Brazilian Ministry of Foreign Affairs concerning the return of certain funds and securities removed in 1941 by government order from the Brazilian branches of the National City Bank where they had been held on deposit in the names of the Chase National Bank and the Empire Trust Company as trustees for the Brazil Railway Company and the Port of Pará Company respectively.
During the first part of July Mr. Edward Miller of Sullivan & Cromwell visited the Embassy several times to discuss on behalf of the aforementioned trustees, the Brazil Railway Company and the Port of Pará Company, the restitution of the seized funds and securities. As the result of these discussions it was agreed that the Embassy would address a communication to the Ministry of Foreign Affairs reiterating the reservation of all the rights, under Brazilian and international law, of the trustee institutions and urging compliance, at an early date, with the provisions of Minister of Finance certificate of September 28, 1946 directing that the seized cash and securities, as well as dividends on the securities, be returned to the National City Bank.
A copy of the reply26 of the Ministry of Foreign Affairs to the Embassy’s note will be forwarded to the Department when received.
