Urtel 377, July 12.39 US draft treaty does not attempt to define “aggression” since determination whether aggression is being prepared or threat of aggression exists would be made in each case through consultation of all parties on initiative any one of them. Aggression can take so many forms in modern world that definition not practicable [Page 21] and any attempt to define would limit free determination of parties in above consultations. Language of US draft would allow subversion or political attack aimed at subversion by any state against any American state to be regarded as threat of aggression if consultation so determines. Enforcement measures to meet threat of aggression could be taken only with authority Security Council in accordance Art. 53 UN Charter.
