11. Free Port and Economic Questions

Paragraph 11a)—accept draft of United States and United Kingdom Delegations (see Article 30 of draft provisions for Free Port) with the following changes:

a. A Free Port shall be established in the Free Territory and shall be administered on the basis of the provisions of an international instrument drawn up by the Council of Foreign Ministers and approved by the Security Council. (omit words “controlling the Free Port of Trieste”)

The Government of the Free Territory shall enact all necessary legislation and take all necessary steps to implement the provisions of such instrument.”

Paragraph 11b)—accept the draft of the French Delegations with the following changes:

b) The establishment of free zones under the exclusive jurisdiction of any country, with the exception of neighboring countries, is incompatible with the Statute of the Free Territory and of the Free Port.”

Paragraphs 11c) and d)—Paragraph 11c is accepted without amendment provided the following wording is adopted for Paragraph 11d).

d) In order to enesure favorable conditions for the economic development of the Free Territory of Trieste economic collaboration shall be established between the Free Territory and Yugoslavia (customs union, joint administration of the railroads of the Free Territory of Trieste, etc.)”

  2. This paper is virtually identical with the original draft (CFM(46)(NY) 15, November 17, 1946), except for a slight revision in sub-paragraph d.
  3. The paragraph under reference is that of the French proposal for article 16 of the Draft Peace Treaty with Italy as included in the Record of Recommendations of the Peace Conference, vol. iv, p. 895.
