I Opening of the Third Session of the Council

Mr. Byrnes, on behalf of the United States Government, welcomed the members of the Council on the occasion of the opening of the Council’s third session in New York.

M. Molotov moved and Mr. Bevin and M. Couve de Murville seconded that Mr. Byrnes should take the Chair.

II Procedure of the Council

It was agreed that the Chairmanship should be held in turn by each member of the Council.

III Recommendations of the Paris Conference on the Draft Peace Treaty With Italy13

The Council proceeded to consider the Paris Conference recommendations on the draft Peace Treaty with Italy.

The Chairman announced the receipt of a communication from the Foreign Minister of Yugoslavia placing the Yugoslav Delegation to the UN Assembly at the Council’s disposal to facilitate the solution of questions still outstanding on the Italian Peace Treaty.14

There was an exchange of views on the question of giving a hearing to the Yugoslav and Italian representatives on the questions dealt with in Article 16 (Statute of the Free Territory of Trieste, Provisional Regime and Free Port Regime) and the related articles. It was agreed that these representatives would be heard and that the Italian and Yugoslav representatives would be present together.

It was agreed that the Secretary General should ascertain and report to the Council what day would be convenient for representatives of the Yugoslav and Italian Governments to be heard by the Council.

Article 10–A. Austro-Italian Agreement15

No agreement was reached on the recommendation adopted by a two-thirds majority of the Paris Conference to include in the Treaty this additional Article.

Article 13, para. 4 Human Rights in Ceded Territories16

After an exchange of views it was agreed to refer to the Deputies a suggestion by the U.S.S.R. Delegation to insert in the text of paragraph 4 as adopted by the Paris Conference, after the word “secure”, a phrase reading:

“in accordance with the fundamental laws of the country in question”.

Article 64, Part B, Reparation17

After an exchange of views on the proportion of reparation payments to be allocated to Yugoslavia and Greece respectively, the decision on this recommendation was deferred.

IV Reservations by the U.S.S.R. Delegation

The U.S.S.R. Delegation indicated that it would wish to revert to the question of Article 14–A18 for which the Conference vote had been 10 for, 10 against, and 1 abstention, and the question of reparation for Albania in connection with Article 64, Part B.
