The Ambassador in the United Kingdom (Winant) to the Secretary of State

Sir: I have the honor to transmit copies of the U.S. draft Directive on United Nations’ Renegades and Quislings93 which has been circulated in the European Advisory Commission, for information only, as E.A.C.(45) 64, September 6, 1945.

This revised draft of a Directive on the same subject circulated by the British Delegation94 was sent to London with the Department’s [Page 536] instruction No. 5546 of May 31, 1945, for the guidance of the U.S. Representative on the European Advisory Commission. It was decided not to circulate this Directive until the Agreement on Certain Additional Requirements to be Imposed on Germany had been signed in the Commission and approved by the Soviet Government. Article 38 of the Agreement, which had been introduced by the Soviet Delegation, had been approved by the Commission before the U.S. Delegation received the draft Directive, and to have reopened the discussions on the basis of paragraph 5 of the Directive would undoubtedly have further delayed the signing of the Agreement. The U.S. Delegation was most anxious to have the Agreement signed and felt that the implementation of Article 38 of the Agreement could be worked out in Berlin, where the U.S. Representative on the Control Council would of course be guided by the policy set forth in the Directive.
