498. In reply to my question based on the Department’s 285, October 4, 6 p.m., Foreign Office stated that the attitude of British Government reported in my 493, October 4, 9 [4?] p.m., “is based upon legal considerations since no declaration of war exists”. Foreign Office added, however, that the anticipated action of the Council over this week-end or Monday would presumably alter the present status. Since this is all information obtainable today I will again raise the question on Monday.
