403. Your 776, October 15, 11 a.m., in regard to regulations governing pilots at Shanghai. With regard to specific treaty citations see:

1.
Sino-American Treaties of 1844,82 Article 8 and of 1858,83 Article 17;
2.
Sino-British Treaty of 1858,84 Article 35;
3.
Sino-Italian Treaty of 1866,85 Article 34 (a new treaty has now been concluded between Italy and China,86 but this provision is pertinent [Page 594] as it describes the method by which pilotage dues and questions have been determined in China);
4.
The Sino-French Treaties of 1844,87 Article 11, and of 1858,88 Article 15;
5.
The Boxer Protocol of 1901, Annex 17, Articles 1, 4 and 22;
6.
The Whangpoo Conservancy Agreement of 1905, Article 1. (Although the Whangpoo Conservancy Agreement of 1912 does not make specific mention of the appointment and supervision of pilots, it would appear that the provisions of the Boxer Protocol and the Whangpoo Conservancy Agreement of 1905 were continued and are still in effect.)
