The Acting Secretary of State to the Minister in China (MacMurray)
376. Referring to Nanking despatch No. D28 of October 770 regarding Chinese patent law promulgated June 18, 1928, Department believes that it would be well to call attention of Chinese Government to fact that this patent law fails to provide a method of according protection in China to United States patent rights issued to American citizens, and to express the hope that the National Government will at an early date take steps to remedy this situation with a view to [Page 611] according to citizens of the United States protection of their patent rights in China similar to that which is accorded to Chinese citizens in the United States, as provided in Article X of the treaty of 1903 between the United States and China.71 Please keep Department informed of developments.
