The Secretary of State to the Minister in Costa Rica (Davis)

Sir: The Department has received your despatch No. 51 of June 15, 1922, respecting the ratification of the Extradition Convention by the Congress of Costa Rica.

You are instructed to advise the Foreign Office that this Government cannot agree to the modification as indicated in Article 2 of the [Page 987] Costa Rican decree of ratification. You may indicate, however, the willingness of this Government to effect an exchange of notes similar to that which followed the signing of the Extradition Convention with Portugal in 1908 as set forth at pages 1475 and 1476 in the Compilation entitled “Treaties, Conventions, International Acts, Protocols and Agreements Between the United States and Other Powers”.13

In advising and consenting to the ratification of the Extradition Convention with Portugal, the Senate of the United States expressed its understanding that the agreement just before mentioned would, in effect, form part of the treaty.

In conclusion you may express the hope that the Government of Costa Rica will acquiesce in the plan proposed for an exchange of notes embodying substantially the modification now expressed in Article 2 of the Costa Rican decree of ratification.
