Your August 26, 3 p.m. During the course of the present conflict, this Government has followed the procedure of giving notification to both the Chinese and Japanese Governments of the movements of American commercial vessels and aircraft in the area of hostilities. These notifications have been given on the basis of courtesy and practical expediency without waiving any legal right. Accordingly the Department perceives no objection to your communicating to the Pan American Airways the statement and the suggestion of your Japanese colleague. You should make it clear, however, that any action which the Company acting in behalf of the China National Aviation Corporation feels prompted to take must be on its own responsibility.
