The Ambassador in Chile (Culbertson) to the Secretary of State

114. With the mails arriving tomorrow at Arica I have obtained in writing from the Chilean Government provisional permission under which Pan American-Grace Airways can fly and carry mail in Chile without prejudice to the efforts which we are now making to have [Page 569] the decree revised. Referring to my despatch No. 214 June 25.23 The chief provisions of the decree to which objection is being made are:
- 1.
- The restriction on types of motors under clause 4.
- 2.
- Clause 6 because it violates article 12 of the Havana convention.
- 3.
- Clause 8 which requires that the company expend a large sum of money for night flying equipment.
- 4.
- Clause 10 which provides that 50 per cent of fares charged by company for carrying passengers within Chile must be paid to the Government.
These two last provisions are regarded … by the military authorities as contributions to be exacted from the Pan American for the benefit of national commercial aviation within Chile.
