Mr. Seward to Lord Lyons.

My Lord: Credible information having been received at this department that Bennet G. Burley, charged with crimes of piracy and robbery, and assault with intent to commit murder, on board the United States merchant steamer Philo Parsons, upon Lake Erie, and within the jurisdiction of the United States, is a fugitive from the justice of the United States in Canada, and that he is now held in custody at Toronto, in that province, awaiting the requisition of this government for his extradition, in virtue of the provisions of the tenth article of the treaty of Washington, I have now the honor to request, through your lordship, that her Majesty’s government may be pleased to issue the necessary warrant for the delivery of the aforenamed Bennet G. Burley to Joseph Dim-mick and James Henry, or to any other person or persons who may be duly authorized by the marshal of the United States for the eastern district of Michigan to receive the said fugitive’, and to bring him back to the United States for trial.
