4036. Department has heretofore held that any naturalized American citizen who has resided in foreign state for a period which would bring him within scope Section 404 of Nationality Act if he remains in such country until October 14, next, and does not relinquish residence and is physically outside of such country before date mentioned will lose citizenship unless he comes within scope Section 405 or 406. Department has no discretion in application of Section 404. In circumstances it is desired that you again take up matter with appropriate British officials suggesting necessity of advancement of date of sailing by at least 2 days. If such advancement impossible suggest naturalized American citizens concerned proceed on or before October 13 to Eire to await sailing arrangements.

Validation of passports for return by ship of category indicated by you seems to offer a solution to most pressing cases. It is understood, however, that all sailings are undertaken with knowledge of risks involved.
